Terms and Conditions

By entering the Competition, you agree to be bound by the following Terms and Conditions:

PROMOTER

The Promoter is Viva Energy Retail SMGB Pty Ltd (ABN 44 670 895 904) trading as Smokemart & GiftBox (Promoter), 270 The Parade, Kensington, SA 5068.

 

COMPETITION PERIOD

The Competition commences at 9:00 AM (AEST) on Saturday 16 May 2026 and ends at 11:59 PM (AEST) on Friday 22 May 2026 (the Competition Period).

 

ELIGIBLE ENTRANTS

Entry is open to Australian residents aged 18 years and over.

 

Directors, officers and employees of:

• the Promoter; or
• any companies or Commonwealth, State, Territory or local government agencies where the rules or guidelines applicable to such company or agency prohibit receipt of a prize; or
• the agencies or companies associated with this Competition,and their immediate family members, cannot enter. Any person who meets the above criteria is an Eligible Entrant. Entrance into the Competition is deemed acceptance of these Terms and Conditions.

 

HOW TO ENTER

During the Competition Period, Eligible Entrants must click the entry button in the Ovaro Home giveaway email sent by GiftBox. One click constitutes one entry into the Competition (Eligible Entry).

No purchase is necessary to enter. Entry is free.

All entries are deemed received at the time of receipt by the Promoter. The Promoter reserves the right to exclude any incomplete or incorrect entry.

 

MAXIMUM ENTRIES

One (1) Eligible Entry per Eligible Entrant per email address.

 

PRIZE DRAW

The Winner will be drawn randomly by an employee of the Promoter at 270 The Parade, Kensington, SA 5068 (Draw Location) at 12:00pm (AEST) on Monday 26 May 2026 (Draw). The draw will be conducted using random.org or equivalent verified random selection tool.

There will be one (1) Winner of the Competition. Each Eligible Entry has an equal chance of being drawn.

The Promoter may draw additional reserve entries and record them in order, in case a Winner is deemed invalid or a Prize is unclaimed.

 

PRIZE

There is one (1) prize available:

One (1) Petal Accent Chair from the Ovaro Home range

Recommended Retail Value: $399.99 AUD (inclusive of GST)

Winner may select their preferred colour from the colours available at the time of winning

The Prize is not transferrable or exchangeable and is not redeemable for cash. The Promoter reserves the right to provide, in substitution for the Prize, an alternative prize of equal or greater value if, for any reason whatsoever, the Promoter is unable to provide the Prize.

 

NOTIFICATION AND CLAIMING THE PRIZE

The Winner will be notified by email within 48 hours of the draw on Monday 26 May 2026, using the email address associated with their entry.

The Winner must respond within 7 days of notification confirming their preferred chair colour and delivery address. If the Winner does not respond within 7 days, the Promoter may deem the Prize forfeited and select a Reserve Winner.

The Prize will be delivered to an Australian residential or business address nominated by the Winner. Delivery is included at no cost to the Winner. Allow 7 to 14 business days from confirmation of delivery details.

 

PUBLICATION OF WINNER

The first name and state of the Winner will be published at https://www.giftbox.com.au/ovaro-home-giveaway-terms-conditions within 28 days of the draw. By entering, entrants consent to their first name and state being published in this manner.

 

RESERVE DRAW

In the event that a Winner fails to respond within 7 days, the Prize will be forfeited and the Promoter will choose and notify a new Winner from the Reserve Winners in the order they were drawn. The

Reserve Winner must respond within 24 hours of being notified. In the event that the Prize is unclaimed following this period, the Prize may be distributed at the Promoter’s absolute discretion.

 

DISQUALIFICATION

The Promoter may, in its sole discretion, discard or deem invalid any Eligible Entry or disqualify all entries by any Eligible Entrant if the relevant Eligible Entrant:

breaches these Terms and Conditions;

tampers with the entry process;

engages in any conduct that may jeopardise the fair and proper conduct of the Competition;

acts in a disruptive, threatening, abusive or harassing manner; or

breaches any applicable law.

 

ACKNOWLEDGMENTS BY PARTICIPANTS

You acknowledge and agree that:

 

The Promoter’s decision in connection with any aspect of this Competition is final and no discussion or correspondence will be entered into.

If for any reason any aspect of this Competition is not capable of running as planned, the Promoter may cancel, terminate, modify or suspend the Competition, subject to any applicable laws.

Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.

The Winner agrees to participate in reasonable publicity activities required by the Promoter, including being announced by first name and state.

 

LIMITATION OF LIABILITY

To the extent permitted by law, the Promoter and its associated agencies, companies and representatives shall not be liable for:

 

any loss, damage or expense howsoever caused in connection with this Competition;

entries or correspondence that are misplaced, misdirected, delayed, lost or incorrectly submitted; or

any loss of, damage to or delay in delivery of the Prize where such failure is beyond the control of the Promoter.

 

SOCIAL MEDIA

This Competition is in no way sponsored, endorsed or administered by, or associated with, Meta, Instagram, Facebook or any other social media platform. Entrants completely release such platforms

from any and all liability in connection with this Competition.

 

PRIVACY

By entering the Competition and providing your personal information, you consent to the use of your personal information in the manner set out in these Terms and Conditions.

The Promoter collects personal information about you in order to conduct the Competition. If the personal information requested is not provided, you may not be able to participate.

The Promoter may also use your personal information to contact you with special offers and marketing, and share it with the Promoter’s Australian related companies, agents and promotional partners.

GOVERNING LAW

These Terms and Conditions are governed by the laws of South Australia, Australia.
